Press Release — The Lexus Project, a New York-based based, non-profit animal rights group was informed about the killing of Junior, a 2-year old gog, on Saturday, 8/18/2012, by Tri-City Animal Shelter, in Fremont, California.
The following is part of public record in Case 3:12-CV04333SI, Mittasch, et.al, v. City of Fremont, et.al., that was heard on Friday, 8/17/2012, in the United States District Court of the Northern District of California located at the Ronald V. Dellums Federal Building, Oakland, California, under presiding Judge Susan Illston.
On 8/7/2012, a dog owner contacted a Southern-California based Animal Rescue via email after what appeared to be a provoked incident that occurred 3 days prior within her gated front property, and involved Junior – her family’s 2-year old dog, and her 9-year old niece. The rescue, a qualified 501c3 organization with a documented track record for pulling and successfully re-homing nearly 800 dogs from California shelters throughout California since 2006, contacted Tri-City Animal Control (Fremont) on the following morning and requested Junior be taken into their rescue under California’s “The Hayden Act.” Rescue was denied access to Junior citing that Junior had been “declared dangerous,” despite the fact there were zero prior incidents involving Junior, and that Junior had not been given an administrative hearing, as allowed under law, prior to a “dangerous dog” declaration being made.
Junior obtained the legal representation of The Lexus Project “TLP” (www.thelexusproject.org) and local legal counsel, both that took the case Pro-Bono. Legal Counsel immediately contested the “City’s” right to kill Junior; requested a “stay of execution” from 8/15/2012 to 8/17/2012, and formally requested a hearing to appeal the City’s “dangerous dog declaration of Junior” and allow him to be taken into rescue. The City Attorney’s office of the City of Fremont responded in writing that they denied TLP’s request for a hearing, and they “… were not destroying the dog pursuant to Fremont’s Municipal Code, but “…rather pursuant to the power to as the owner of the dog” and further denied the rescue right to take Junior into rescue. On 8/16/2012, Junior’s legal counsel filed a Temporary Restraining Order (TRO) and Federal Complaint against the City of Fremont, and on 8/17/2012, the matter was heard by Presiding Judge Susan Illston. Despite the fact that there was jurisdiction, merits for the case to be heard, and Federal and State laws that supported Plaintiff’s request, Judge Susan Illston took immediate issue with the Plaintiff’s “right” to insert themselves between the former owner, and the new owner, the City of Fremont.
Judge Susan Illston’s statement during the Request for TRO hearing to the Plaintiff’s counsel, in part, “SO IF I MOVED AND DIDN’T WANT TO TAKE MY DOG, YOU MEAN TO TELL ME I COULDN’T HAVE HIM KILLED?” is evidence of her disregard for Federal and State law; her complete lack of human compassion towards Junior or the specifics of his individual case; her thoughts on her “rights” to her own dog her personal opinion towards any dog which is considered “property”, and, a “A Dog Owner’s right to Ownership of their Property (Animal) and what a Dog Owner should be allowed to do with their property.”
It is deeply concerning that the Judge would not hear the reasons for the request for the Temporary Restraining Order and then decide whether to issue a TRO or not. Instead, Judge Illston ruled that Plaintiff’s had “no standing” because the City of Fremont now “owned” the dog. Her ruling also meant that she believed that the Co-Plaintiffs, RESCUE, had no legal right to question the intent of Junior’s new owner’s (the City of Fremont) “right” to kill a healthy, 2-year old dog and take him rescue, as is allowed under California State Law and The Hayden Act.
It is also deeply concerning that Federal Court Judge Susan Illston refused to hear the reasons behind the request for TRO and instead immediately denied the Request for the TRO – which asked for nothing more but to extend Junior’s execution by a few weeks until the case was heard and the facts presented by both parties were considered.
It is our belief that every judge, whether they preside over a Small Claims, Municipal, Superior, State, Federal, or Supreme Court, has a duty to carefully consider all points carefully, review all applicable laws, put their own personal opinions aside, at least publically in a Court of Law, and hear, and rule, on the individual merits of each case before issuing a ruling, especially if the subject of the TRO and Complaint is a 2-year old dog with no prior incidents. If a Judge does not have enough information or knowledge of all applicable laws or case law at the time a Request for TRO is made, a Judge should grant the requesting parties a TRO, continue to research the matter or applicable laws, and allow the case to be heard.
Instead, a Federally-appointed judge demonstrated her personal-bias and opinion with regard to “property ownership”; disregarded the fact that the “property” was a 2-year old dog whose life was about to be ended 3 hours later; denied Plaintiff’s request for a TRO to temporarily “stay” Junior’s execution, and refused to hear the case. The Judge’s ruling granted the City of Fremont “the right” to kill Junior because she personally supported the City’s assertion that an owner of a dog should have the power to kill that dog, if, for no other reason, than because they are the owner of the dog.
Junior was denied any due process as allowed under law and declared dangerous. This was his first and only incident, it occurred at his home, and after he made the fatal mistake of acting to protect his 5-year old owner against what was seemingly a threat to the 5-year old boy. The 9-year old victim was treated for her injury immediately following the incident and back home a few hours later. The rescue was denied their right to take Junior into rescue as provided under The Hayden Act, and using Judge Illston’s reasoning, perhaps we should all reconsider whether Michael Vick’s actions, for which he was prosecuted and served jail time for, should have been excused. After all, he was the legal owner of his dogs.
This morning, Saturday, 8/18/2012, under the orders of Sgt. Howard Russel, Administrator of Tri City Animal Control, Animal Control Officer Lorenzo Talatala ended the life of Junior, a healthy, 2-year old dog.
Yesterday’s court proceeding was a very sad day for voters in California who voted for The Hayden Act and put this law into place. It was also a particularly frightening day for the residents of Alameda County, California, should they ever find themselves in Judge Susan Illston’s courtroom.

Aside from that misinformation, I stand with you that more could have and should have been done to preserve this poor dog’s life. A dog owner myself, I grieve for Junior in his defenselessness and hope that the necessary steps are taken to prevent similar instances in the future.
That’s right. They are dogs. And we HUMANS need to respect that fact. The dog did what it should have done-protect its owner! Humans continue to fail animals on a daily basis and it is sickening. Biting does not make a dog dangerous. There is such a thing as a justified bite. I hope the judge gets thrown out. If anyone needs someone to picket with them let me know. Yes dogs are dogs and are living creatures and should be treated as such. I have owned dogs my whole life and currently have two and have never had any of them bite anyone. People fail dogs by not being responsible owners. This judge completely disregarded the law which is a huge concern on many levels.

I think people are missing the point here: Yes- it is obvious to those who are animal lovers or who follow dog law, that this was a total miscarriage of justice.
And to think this was a case, where no one was seriously maimed,mauled or even killed.
No one died- except of course, this poor Akita who was just being a protective, loving dog .
Clearly this Judge doesn’t really give a hoot about a canine life or she would not have rendered such a hasty and moronic decision.
So for the 3rd time in a week I read of another dog dying for doing what canines( regardless of their breed) do naturally, inherently and instinctively: protect all that is important to them.
It has been what they have done for years since humans domesticated them:they protect family- home or property and sometimes all 3 at once.
This was not a bad dog- an evil dog or a dangerous dog. This was a dog that sensed danger, in his mind.
Trust me- any dog, any breed, that is large/ powerful could have reacted the same and rendered serious damage to a person it saw as a threat, but notice the dog *warned* the 9 yr old.
An Akita and many other breeds could do very serious damage if they wanted to- apparently he didn’t or this little girl would not even be alive.
Such is the curse on canines- they cannot speak. So they cannot warn people to back off.
They have no options left but vocalization and their teeth.
They have to resort to certain measures that people don’t understand. Since most people don’t fully understand K9 behavior or how to read it, it leads to lots of mishaps- with the dog coming out on the losing end, all too often.
Whether the warning they send is raised hackles, facial expressions,a growl- or the * stop it* snap/nip, most people just don’t bother to learn or read K9 body language; and I do not expect a 9 yr old child to comprehend such either.
Also all parents should warn their children about their behavior around dogs- both strange and those they know. A dog that feels threatened can’t say” Leave me alone”. I have seen too many ignorant to downright stupid parents allow their kids to run up to strange dogs with the intent of petting them.
As if any dog on a leash in public equates with being a human friendly dog. This is just not the case.
Just like you don’t like every person you meet- not all dogs like other dogs and certainly we know- not all dogs are human friendly except for their own family members.
If you intimidate, frightened, annoy or anger a dog enough, something’s got to give. But it does not have to be this way if people learned to respect a dog’s personal space.
Karma will offer this judge a payback some day, for this tragic decision of a murder verdict for Junior.

Thank you, very well spoken. Its very sad how many people can just get a dog and never truly understand it and nonetheless the public can do what they do. So this dog doing what its supposed to do does it and doesnt understand why its not with the owner anymore and why now its getting ivs and getting sleepy and dying from doing what its supposed to do. A dog that I had several years ago was outside on a tie out and a neighbor provoked him to nip at him and he called animal control. The officer told him that there were only 2 things that the dog could do at the time and that was fight or flight (wow amazing that its just like humans in that sense) and it did what it had to do to let the guy know to leave him alone and nothing more came out of it. Its tragic that more and more this is happening and these higher authority people think its okay especially when their job is to PROTECT.And her statement made her sound so IGNORANT. No i absolutely dont think anyone should have the right to put their pet to sleep just because they move. Who made us GOD to decide someones or pets life just cause we dont want the pet anymore. There are homes that this dog could have been placed in instead of the fate that it got. The only way this should take place is if a pet is very ill beyond comfort or viciously dangerous where it cant be rehabilitated. I believe in Karma 10 fold and one day this lady and the people that stepped up to ask for this will feel it one day

It is truly a sad when an appointed Federal judge, who is supposed to be fair and unbiased, has such disregard for a living being that she fails to do her duty and review the facts of this case. A simple TRO was all that was asked. A little more time to determine, with fairness and independent evaluation, whether Junior was a dangerous dog or not. No compassion for a life.
This was indeed a murder. Junior’s blood is on Susan Illston’s hand. Junior’s blood is on the hands of all those at Tri-City Animal Shelter who were involved in this decision process. A greater judgement awaits us all and all those involved in this travesty of judgement and tragic ending for this young Akita will answer to it’s creator!!

A dog is chattel and murder is the unlawful killing of another human being. Your implied equivalency between humans and animals is degrading to humans. Recently, a woman I know did not have the resources to care for her two cats. She was told she had to pay over $100.00 for a shelter to take her cats. Thankfully a friend was able to give her the money that she can’t afford to pay back. Without the generosity of friends, she would have to kill the cats herself or, as too often happens, abandon them to the street.
The issue is that many people who own animals are in no position to be animal owners. Their selfish needs come before the animals best interest. It is ownership none the less and all that ownership implies.
Finally, to equate pets with children is obscene. I have seen my parents and others bury their children and my son is missing. The difference between children and pets is many orders of magnitude.

Philip, first I would like to offer my deepest condolences for your missing child. That is one of the greatest sources of pain a human could be asked to endure.
You are completely correct in stating that our dogs should not be equated to children. BUT- our horror over the Judge’s complete lack of regard for this animal’s life is also justified.
There is a sacred bond between a human and their dog. They have an instinctual drive to protect us and us, them. This bond has been forged over thousands of years. Legally, our animals are chattel. Correct. And it appears that this Judge may have overstepped her authority by disregarding the law. You are right that some do not have the means to care for their animals properly… but that is not at issue, here. This is a middle class family who wants a proper hearing on whether or not the bite was justified. Instead, a Judge ordered the dog to be destroyed.
A dog’s life is precious. All life is precious. This dog deserved a hearing. at the very least.

Small minded, uneducated and inhumane people shouldn’t be allowed to pass judgement on any animal. When it comes to the government…anything or anyone they can’t get money from doesn’t matter to them. They would rather toss them away than show an interest. They are the worse animal abusers.
This judge should not have been presiding over this case or any case that involves animals. She has shown absolutely no respect for them or their owners. A heartless individual to say the least. Please share with as many people that you can so Juniors death doesn’t go unheard. All the shelter had to do is let rescue take Junior there were so many people that wanted him. This article is fantastic but it is only part of the story and would of been long if everything was told. It was terrible.. Please keep his death in the news.
While I totally agree that the judge did not do her duty and showed bias in her hasty decision something a judge should never do no matter who animal or human that comes before the bench, I would remind everyone that the owners of Junior failed him first in that they relinquished ownership to the county in the first place. They signed the papers that turned over ownership of Junior.
The residents of that community need to take action and make sure that breed specific legislation and dangerous dog classifications based on breed alone does not become law in their community and then as everyone of us has the power to do vote for the judges you want to serve or vote OUT the judges based on their record in their courtrooms. If you do that than Juniors death will stand for something.

We need some safeguards in place to do damage control when we see unnecessary loss of life because of ignorant pet owners, idiotic animal shelters and/or rotten judges.

Clearly, by reading part of the text in this article, the Judge sounds like if she were to move and didn’t want to take her dog, she would want it killed. What happened to Junior was a travesty. He did one thing wrong because he was protecting a 5 year old family member whom he thought was in danger. this is what some pets do, protect family. This dog was given no chance at life. The fact that even a rescue organization that was willing to take him and were told no just goes to show that these people don’t care about animals or their welfare. Cheryl, I read what Philip and i think he is crazy. I do agree with what you said about pets sometimes taking the place of children for those who can’t have them. My girlfriend is in that situation. They tried for quite some time to have a child and nothing seemed to work. Even went to a specialist and that didn’t work. So they have had dogs and each dog is like a child to her.

There was NO excuse for Fremont, Illston, and Tri City Animal Detroyers to kill 2 year old Junior, the Akita. He was defending his 5 year old boy. Animal’s lives are important, too. Illston didn’t even let Junior have a chance to live. Soulless, heartless, jackasses should not have the power of life and death over others. Rescuers were jumping through hoops trying to save poor Junior. Junior didn’t even get a hearing, didn’t get a chance. I have never met “just a dog.” My 4-legged furbabies may be canine but they are my babies, my children.
This “Just a dog” was not owned by the city it was owned by the human family and continued to be family until they got their day in court about if it was right to declare the “Just a dog” dangerous.

The judge was biased, I would have turned around and walked into the next courtroom and claimed bias asked them to grant the temp stay…
A lot of people don’t believe that furbabies have the same rights as humans so take it all the way back to where they took the humans property away without giving that person their day in court…

Phillip, you need some serious psychological counseling is all I can say! IF your child is actually missing as you say (it may well be the child is with the more responsible of their two parents, you certainly wouldn’t qualify). If I had a missing child, the absolute last place I would be is posting on this page supporting the senseless destruction of this furry friend…I’d be doing something productive to locate my child. Get some help.
OK, judges are not elected on a federal level, they are appointed. In this case there are two approaches at least that can be taken to hold this miserable heartless broad’s feet to the fire. First off, do a little homework and determine who appointed her to a seat she is obviously not fit to occupy, and let THEM know what you think of their choices regarding who they appoint to the bench.
Secondly, you file complaints with the federal Justice Department and ask that they investigate her complete lack of regard or consideration for those laws her decision violated with an eye towards a judicial misconduct complaint and subsequent investigation.
Thirdly, you flood this woman with mail in which you indicate your displeasure with her. Judges only feel they ARE the law if they think nobody is looking. If you are an animal rights group or activist, you can file a complaint or series of complaints for judicial misconduct that will literally result in having her Akita hating butt tossed off the bench.
These judges should be thrown off the bench. Such a remark as people have the right to kill their pets if they moved and didn’t want them is ludicrous, crazy and mentally unbalanced. If you cannot trust their judgement in a simple case such as this in judgement, common sense, fairness, and justice for all living things, how can we trust their judgement on more complex cases? All the government employees that were involved in this case should actually be given mental evaluations before letting them return to their government jobs serving the citizens (us…who pay their wages). I don’t understand why they made such a big deal why they were head strong on killing? Are they psychotic, do they like inflicting pain and suffering on others, do they have a “God-Like Complex”? I don’t understand what was the big deal why they couldn’t let Junior live and save his suffering and all the humans involved in saving him….their suffering and save the tax payers all this nonsense in court. This whole thing is ridiculous to me, they completely made a mountain out of a molehill, the rescue offered to take Junior and that should have been that. Their mental status has to be questioned and if we, the citizens, think they are competent to continue their jobs as our public servants.
